These Terms of Service apply to Bangladesh Online Limited Members or any other person authorized by the Member to use his/her account.

DEFINITIONS: In these Terms of Service "BOL" means Bangladesh Online Limited, "Member or You" means anyone who has an account / membership with BOL.

1. In the Internet Access Services, a member is allowed to use the computer in the domain "bol-online.com", and any other related domains to connect to the Internet in order to use Internet services such as electronic mail, database searches, etc. at BOL, and other networks all over the world. The services at BOL are provided for sending and receiving information for business, commerce, education and research for economic and social development.

2. The member agrees to abide by all the rules, regulations, netiquette already existing or to be announced later at BOL, BTTB, or Internet Society. At least, the member agrees not to use the Internet to violate the privacy of any other person, no matter whether or not there is any protection on any part of the system or not. The member agrees not to distribute a private E-Mail to any other person without having permission from that person. The member may not use any impolite language and/or defamatory message in the public part of the network, such as in any newsgroup or mailing list. If the member violates netiquette, he/she agrees to accept all the responsibilities and consequential liability. BOL will not share any responsibility or charges with the member. The member agrees to take all measures necessary and desirable to keep his/her password secret. Members agree to change his/her password as often as necessary and desirable.

   In the services from BOL, the member is not allowed to send or receive government secret or illegal information (such as copyrighted information for which the member has not received permission or information, which is threatening or defamatory or obscene, etc.). The member agrees that if he/she is accused of breaking the law, would not hold BOL responsible in any aspect at all. In BOL services, the member is not allowed to let any other person use his/her account, or lease or sale the usage of his/her account to any other individual or institute.

   A member is not allowed to use BOL to break into and/or using any services and facility connected to the Internet where he/she is not authorized to do so. Warranties
    

   1. Except for certain products and services specifically identified as being offered by BOL, BOL does not control any information, products or services on the Internet and except for such BOL-identified content, all merchandise, information and services offered, made available, or accessible on the Internet are by third parties who are not affiliated with BOL.

      Members assume full responsibility and risk for use of the service and the Internet. The service is provided on an "as is" and "as available" basis. BOL does not warrant that the service will be uninterrupted or error-free or that any information, software or other material accessible via the service is free of viruses, worms, trojan horses, or other harmful components. BOL makes no express or implied warranties, representations or endorsements including, but not limited to, warranties of title, non-infringement or implied warranties of merchantability or fitness for a particular purpose regarding any merchandise, information or service provided through BOL or on the internet generally. No advice or information given by BOL, its employees, affiliates or contractors shall create a warranty.

      BOL shall not be liable for any costs or damages arising directly or indirectly from use of the service. It is solely member's responsibility to evaluate the accuracy, completeness, and usefulness of all opinions, advice, services, and other information, and the quality and merchantability of all merchandise provided through the service or on the Internet generally. BOL is not liable for any damages may caused by the quality of the communication circuit, installation disks/CDs or any other media and/or software, by non-delivery of messages and/or files or delivery to wrong place, or damage to messages and/or files, or damages caused by any other member.

      Under no circumstances shall BOL, its Employees, Affiliates or Contractors be liable for any direct, indirect, incidental, special, punitive, or consequential damages that result in any way from any: use of your account or the service or your inability to use the service; access of the internet or any part thereof; or, your reliance on or use of information, services or merchandise provided on or through the service or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation or transmission, or any failure of performance.

   2. The Internet contains unedited materials, some of which are sexually explicit or may be offensive to member or others accessing the service through his/her account. Members access such materials and permit others to access such materials through his/her account at his/her own risk. BOL has no control over and accepts no responsibility for such materials.
       

   BOL reserves the right to deny membership to any applicant without having to give any explanation, and reserves the right to suspend or cancel the membership and usage of the system to any member who violated or attempted to violate the rules, regulations, and netiquette without having to give any advance notice.

   BOL will try to grant the login ID as requested by the applicant but reserves the right to assign another ID if the requested ID is the same as another existing one or not suitable. BOL will install access and other required software on only one Computer System identified by the member. This computer system must be in full working order and possess all the necessary hardware and software to access the internet, including but not limited to: Monitor, Mouse, Keyboard, sufficient RAM & free Disk Space, CD-ROM drive, Floppy Drive, Modem, working Phone Line attached to the modem.

   BOL reserves the right to change the rates and details of service without prior notice and the changes may be retroactive according to the order or announcement from BTTB and/or other government authority. Credit Policy
   

   1. The last date of payment is the 15th day of the month, following the month for which the bill has been issued. If the payment is not received by the 15th then the member account will be temporarily suspended on the 17th of the month. If the bill is paid after the 15th then it is the member's responsibility to furnish BOL with the proof of payment by fax or courier/mail. BOL will re-activate the account once the proof of late payment is received from the member. Members not paying within two(2) months will be permanently deleted from BOL database.
      
   2. Once any member is permanently deleted for non-payment, BOL reserves the right to deny any request for fresh sign-up.
       

   Service Change
    

   1. A service change requires the member to send his signed request in writing, either by FAX or by Mail (not e-mail).

      Upgrade from Anirban to Aparajita will be effective from the beginning of the service period when BOL receives the request for an upgrade.

      Upgrade to Asheem will be effective from the beginning of the service period when BOL receives the upgrade fee of Tk. 1000.

   2. Any downgrade will be effective from the next service period after receiving the request. No re-fund/adjustments of sign-up fee will be provided for downgrading from Asheem service.
       

   Indemnity. Members agree to defend, indemnify, and hold BOL and its affiliates harmless from any and all liabilities, costs, and expenses, including reasonable attorneys' fees, related to or arising from: any violation of this agreement by you or those who access the Service through your account; and, the use of the Service or the Internet and the placement or transmission of any message, information, software, or other materials on the Internet by you or by those who have access to the Service through your account.

   Term of Agreement. This Agreement is effective from your acceptance thereof, which is indicated by your signature on the Membership Form or upon the first use of the Service through your account, whichever is first. If you are a current BOL member when this Agreement is activated, your continued use of the Service constitutes your acceptance of this Agreement.

3. Termination of Agreement
    

   1. Members may terminate this Agreement by using only written and signed application. E-MAIL & VERBAL CANCELLATIONS WILL NOT BE ACCEPTED. Charges to your account will stop accruing from the following working day your application receipt or from the mentioned date in the application whichever is later. BOL does not issue pro rata fee refunds.

      BOL may terminate this Agreement: at any time without cause upon 30 days prior notice; or, immediately upon notice if you, or any person who has access to the Service through your account, commit a material breach of this Agreement, including but not limited to a breach of any obligation imposed in "Subscriber Acceptable Use Policy" or you fail to pay any charges within 30 days of the date they accrue.

      Upon termination of this Agreement all rights granted to the member under this Agreement shall immediately cease and terminate; and, the member must destroy or return to BOL all copies of software and documentation that he/she received from BOL.

   2. Termination of this Agreement does not release you from the obligation to pay all accrued charges under this Agreement.
